We may make changes to these Terms and Conditions from time to time, by posting an updated version to our website.  Where we make any material changes, we will give reasonable notice (via posting on our website) before the changes take effect.

If we make changes to these Terms and Conditions and, if applicable, we have given reasonable notice before the changes take effect,  and you continue to use our website, you will be deemed to have agreed to the changes.

Online Store

To make purchases through our site, you will be required to provide your personal details including your name, phone number, email address, delivery address, payment details and other information we may request from time to time. Please refer to our privacy policy for more information on how we collect, use and hold personal information.

Our products are for personal use only and should be used in accordance with the product’s instructions, precautions and guidelines.

We reserve the right to decline to accept, limit or prohibit any order from any person. This may include where the purchaser is under 18 or 21 years old (where required by the laws of the relevant state or territory of residence), or where, in our judgement, an order appears to have been placed by a reseller or distributor.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our product or this website without our express written permission.

Pricing

All prices on our website are shown in New Zealand dollars ($) and are GST inclusive. We may change the prices of our products from time to time.

Credit and debit card transactions are processed in New Zealand, even for purchases made in foreign currency. If a purchaser makes a purchase online from  outside of New Zealand, local banks may charge overseas transaction fees and/or foreign exchange fees.

Promotions

We reserve the right to verify the validity of any promotional offer when redeemed. If we believe that there has been unauthorised use of a promotional offer or code, we may revoke the order and/or cancel the order in our discretion. Any requirements to qualify for a promotion will be specified in the promotion details.  Free gifts cannot be exchanged for cash, resold by the purchaser, or returned for a refund.

Subscriptions

Flint may from time to time make a subscription service available. By purchasing a subscription service, you will receive regular deliveries of your ordered products at the frequency you choose. At the time of subscription refill, your card will be charged automatically at the product price.  Provided that your card authorises the transaction, your subscription service will continue for the subscription
period and on the terms as described in your subscription order until you cancel or adjust your subscription.

Errors, inaccuracies or omissions

Occasionally, there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, shipping
charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions. We may change or update information, pricing or discounts on our website for any reason without prior notice.  If pricing information for a product is displayed incorrectly, we may cancel any order for that product (including after the order has been submitted). Where you have purchased a subscription, we will provide notice of a price change and an ability to cancel your subscription.

While we try to display the colours of our products accurately, the colours you see will depend on your screen and may not be an accurate representation of the product.

All copyright or intellectual property rights in this material is either  owned by us, or licensed to us by someone else. These rights are protected by intellectual property law. To the extent that we allow you to share parts of this website via social media, please feel free to do so. Other than that, no part or portion of this site may be copied, sold or used without our written permission.

Third Party Advertising, Hyperlinks and Offers

The site may have third party advertisements, referral buttons and other pointers to websites offered by third parties. We have no control over third party websites, and are therefore not responsible for any materials or contents that are linked to our website, or for any goods or services you purchase from such third party websites.

Disclaimers and Limitation of Liability

To the maximum extent permitted by law:

 All orders are  subject to availability, and any product may be withdrawn from sale at any time. If we are unable to fulfil your order within a reasonable time, you will be offered the option of receiving an alternative product up to the value of what you paid for the item you ordered or a refund of the amount you paid or the unavailable product. Please refer to our Shipping, Refunds and Returns Policy for further information.  

The Consumer Guarantees Act 1993 applies to these Terms and Conditions. These Terms and Conditions do not detract from your rights under that Act.

Severability, Entire Agreement

If any part of these Terms and Conditions is deemed invalid, void or for any reason unenforceable, it shall be deemed to be removed and shall not affect the validity and enforceability of the remainder of these Terms and Conditions.These Terms and Conditions, our privacy policy, our Shipping, Returns and Refunds Policy and any contract arising out of this website comprise the entire agreement between Flint and you, and supersedes all prior representations or agreements relating to these Terms and Conditions.

Termination

These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Condition sat any time by notifying us that you wish to terminate these Terms and Conditions. If you terminate these Terms and Conditions, you must immediately stop using our website.

If in our sole judgement you fail, or we suspect that you have failed, to comply with any part of these Terms and Conditions, we may terminate these Terms and Conditions by giving written notice to you.

Force Majeure

We will not be responsible for any delay, suspension or failure arising out of any circumstances outside of our reasonable control, including but not limited to, acts of God, governmental actions, strikes, lockouts or other labour difficulty, war or national emergency, acts of terrorism, fire, explosion, flood, an act or omission of a third party, inability to obtain any necessary materials, equipment, facilities or services, the failure of performance provided by others, internet interruption or virus, accidents or breakdown of plant, machinery, software, hardware or communication network.

No waiver

Governing Law

The laws of New Zealand govern these Terms and Conditions, our privacy policy, our Shipping, Returns and Refunds Policy and any contract arising out of this website and you agree that the Courts of New Zealand have exclusive jurisdiction.
